Gardeners Hook Service Terms and Conditions

These Terms and Conditions govern the provision of gardening and related services by Gardeners Hook to residential and commercial clients in the United Kingdom. By booking or receiving any service from Gardeners Hook, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking or allowing work to commence.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Client means the person, company, or organisation requesting or receiving services from Gardeners Hook.

Services means any gardening, garden maintenance, clearance, soft landscaping, planting, lawn care, hedge work, pruning, seasonal work, or other related services supplied by Gardeners Hook.

Agreement means the contract between Gardeners Hook and the Client for the supply of Services, incorporating these Terms and Conditions and any written or agreed specification.

Visit means any scheduled attendance by Gardeners Hook or its gardeners at the Client’s property for the purpose of carrying out Services.

2. Scope of Services

Gardeners Hook provides a range of gardening and outdoor maintenance services, which may include routine maintenance, one-off tidy ups, garden clearance, planting and soft landscaping, lawn and hedge work, and other similar services as agreed with the Client.

The specific Services to be carried out at each Visit will be confirmed in writing, verbally, or through a booking confirmation. Any additional work requested by the Client during or after a Visit may be treated as a variation and may be charged separately.

3. Booking Process

All Services must be booked in advance. A booking may be made by the Client through any accepted communication method, subject to confirmation by Gardeners Hook.

When making a booking, the Client must provide accurate information about the property, garden size and condition, access arrangements, and any particular requirements or restrictions. Gardeners Hook relies on this information to estimate the time, resources, and cost of the work.

A booking is only considered confirmed once Gardeners Hook has accepted the booking and provided a confirmation of the scheduled Visit and, where applicable, an estimate or quotation. Gardeners Hook reserves the right to decline any booking at its discretion.

For larger projects or work estimated to exceed a single Visit, Gardeners Hook may provide a written quotation and schedule of works. Quotations are usually valid for a limited period as stated in the quotation and may be withdrawn or amended if not accepted within that period.

4. Access and Client Responsibilities

The Client must ensure that Gardeners Hook and its gardeners have safe and reasonable access to the garden and any relevant outdoor areas at the agreed times. This includes providing access through gates, side passages, communal areas, or any other necessary routes.

The Client is responsible for ensuring that pets and children are kept away from the working area for the duration of the Visit, and that any hazards on the property are disclosed in advance. Gardeners Hook may refuse to carry out Services or may suspend work if it considers that conditions are unsafe or unsuitable.

The Client must also ensure that any outdoor water and electricity supplies required for the Services are available and in working order, unless otherwise agreed.

5. Equipment and Materials

Gardeners Hook will ordinarily provide its own tools and equipment required for the Services. Where specific materials are required, such as plants, compost, turf, or other supplies, these may be provided by Gardeners Hook or by the Client, as agreed.

If Gardeners Hook agrees to procure materials on behalf of the Client, the cost of such materials will be added to the invoice, and may require advance payment or a deposit. Gardeners Hook will use reasonable efforts to source materials of suitable quality, but does not guarantee the performance of third-party products, plants, or materials.

Where the Client supplies any materials, the Client is responsible for ensuring that they are suitable for the intended use. Gardeners Hook will not be liable for defects or failures arising from Client-supplied materials.

6. Pricing and Payment Terms

Services may be charged on an hourly rate, fixed price, per Visit fee, or project basis, as agreed in advance. All prices will be communicated to the Client before work commences, either through a quotation, estimate, or current price list information.

Unless otherwise indicated, all prices are stated in pounds sterling and may be subject to applicable taxes. Gardeners Hook reserves the right to revise its rates from time to time. Any revised rates will not affect confirmed quotations unless otherwise stated.

Payment is due in accordance with the terms stated on the invoice or booking confirmation. This may include payment at the end of each Visit, within a set number of days of the invoice date, or in staged payments for larger projects.

Gardeners Hook accepts commonly used payment methods as specified on its invoices or communications. The Client is responsible for ensuring that payment is made in full and on time. Time for payment shall be of the essence of the Agreement.

7. Late Payment and Overdue Accounts

If the Client fails to make any payment when due, Gardeners Hook may, without prejudice to any other rights, charge interest on the overdue amount at a reasonable commercial rate and may suspend or cancel further Services until full payment is received.

Gardeners Hook may also recover from the Client any reasonable costs incurred in pursuing late payments or enforcing these Terms and Conditions, including any fees charged by collection agencies or legal advisers where lawfully recoverable.

8. Cancellations and Rescheduling by the Client

The Client may request to cancel or reschedule a Visit by giving reasonable notice. Gardeners Hook aims to accommodate such requests where possible.

Where Visits are cancelled or rescheduled at short notice, Gardeners Hook reserves the right to charge a cancellation fee or a minimum call-out charge to cover lost time and administrative costs. The applicable notice period and charges will be communicated to the Client in advance or in the booking confirmation.

For larger projects or work involving pre-purchased materials, deposits may be non-refundable if the Client cancels after materials have been purchased or specific preparation work has been undertaken, unless Gardeners Hook is able to mitigate its loss.

9. Cancellations and Rescheduling by Gardeners Hook

Gardeners Hook may cancel or reschedule a Visit due to adverse weather, illness, staff shortages, supply issues, safety concerns, or other circumstances beyond its reasonable control. In such cases, Gardeners Hook will use reasonable efforts to notify the Client as soon as practicable and to arrange an alternative date.

In the event of cancellation by Gardeners Hook, any deposit or prepayment relating solely to the cancelled Visit will either be applied to a rescheduled Visit or, if no rescheduling is possible, may be refunded where appropriate. Gardeners Hook will not be liable for any indirect or consequential loss arising from such cancellations.

10. Service Quality and Complaints

Gardeners Hook aims to provide Services with reasonable care and skill. If the Client is dissatisfied with any aspect of the Services, the Client should raise the matter with Gardeners Hook promptly, ideally within a short period after the Visit.

Gardeners Hook will review any complaint and, where it is found that the Services were not provided in accordance with the Agreement, may offer to rectify the issue, provide a partial refund, or take other appropriate steps. Any remedy will depend on the circumstances and is subject to applicable consumer protection law.

11. Client Property and Existing Garden Conditions

Gardeners Hook will exercise reasonable care when working at the Client’s property. However, the Client acknowledges that gardening work, particularly clearance, pruning, and soft landscaping, can involve disturbance to soil, plants, and existing features.

The Client is responsible for bringing to the attention of Gardeners Hook any hidden features, utility lines, irrigation systems, or fragile structures that may be affected by the Services. Gardeners Hook accepts no liability for damage to features or installations that were not made known or could not reasonably have been identified in advance.

Gardeners Hook is not responsible for any deterioration in plants, lawns, or garden features arising from pre-existing conditions, disease, pests, weather events, lack of watering, or failure to follow care advice provided to the Client.

12. Waste Handling and Disposal

Garden waste generated as part of the Services will be handled in accordance with applicable waste and environmental regulations. The default arrangement for waste handling will be agreed with the Client before work commences.

Where the Client has suitable garden waste bins or composting arrangements, Gardeners Hook may place cuttings, clippings, and similar waste into those facilities as part of the Visit. If removal of green waste from the property is requested or required, additional charges may apply to cover transportation, disposal, or licensed waste handling services.

Gardeners Hook complies with relevant regulations on the transport and disposal of garden waste and will not dispose of waste unlawfully. The Client must not request, and Gardeners Hook will not agree, to any method of disposal that would breach environmental or waste management laws.

13. Use of Subcontractors

Gardeners Hook may, at its discretion, engage subcontractors or third-party gardeners to carry out some or all of the Services. Gardeners Hook will remain responsible for the overall performance of the Agreement and will use reasonable efforts to ensure that subcontractors work to appropriate standards.

The Client agrees that subcontractors may attend the property to perform part or all of the Services under the direction of Gardeners Hook.

14. Liability and Limitations

Gardeners Hook will perform the Services with reasonable care and skill and will use reasonable efforts to avoid damage to the Client’s property. However, to the fullest extent permitted by law, Gardeners Hook’s total liability to the Client for any loss or damage arising out of or in connection with the Agreement shall be limited to the total amount paid or payable by the Client for the specific Visit or project giving rise to the claim.

Gardeners Hook will not be liable for any indirect, consequential, or purely economic loss, including loss of profit, loss of enjoyment, or loss of anticipated savings, arising out of or in connection with the Services, even if such loss was foreseeable.

Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot lawfully be limited or excluded.

15. Insurance

Gardeners Hook aims to maintain appropriate insurance cover in respect of its operations, including public liability cover in line with standard industry practice. Details of insurance can be made available upon reasonable request by the Client.

16. Force Majeure

Gardeners Hook shall not be in breach of the Agreement nor liable for delay or failure in performing any of its obligations where such delay or failure results from events, circumstances, or causes beyond its reasonable control. These may include extreme weather, flooding, storms, acts of nature, labour disputes, illness, supply chain disruptions, or any similar events.

In such circumstances, Gardeners Hook may suspend performance for the duration of the event or, where performance has become impossible or significantly impractical, may terminate the affected part of the Services without liability, other than to refund any payments received for Services not provided.

17. Termination

Either party may terminate an ongoing service arrangement by giving reasonable notice, unless a specific minimum term has been agreed. Termination will not affect any rights or obligations that have already accrued at the date of termination.

Gardeners Hook may terminate the Agreement immediately if the Client repeatedly fails to provide access, fails to pay any invoice when due, or otherwise materially breaches these Terms and Conditions and does not remedy the breach within a reasonable time after being notified.

18. Data Protection and Privacy

Gardeners Hook will handle any personal data provided by the Client in accordance with applicable data protection law. Client information will be used for purposes such as managing bookings, delivering Services, processing payments, and communicating about service-related matters.

Gardeners Hook will take reasonable steps to keep Client information secure and will not sell personal data to third parties. Information may be shared with subcontractors or service providers only where necessary to deliver the Services or administer the Agreement.

19. Changes to Terms and Conditions

Gardeners Hook may update or amend these Terms and Conditions from time to time. Any updated version will apply to new bookings and, where appropriate, to ongoing service arrangements after reasonable notice has been given to the Client.

If the Client continues to use the Services after being notified of any changes, the Client will be deemed to have accepted the updated Terms and Conditions.

20. Governing Law and Jurisdiction

These Terms and Conditions and any Agreement between Gardeners Hook and the Client shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to resolve any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided, without prejudice to any mandatory consumer rights that may provide otherwise.

21. General Provisions

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary or, if not possible, deleted. The remaining provisions shall continue in full force and effect.

No failure or delay by Gardeners Hook in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

The Agreement is between Gardeners Hook and the Client. No other person shall have any rights to enforce any of its terms, whether by statute or otherwise.
